Personal injury cases are typically handled in state courts and each state has their own laws, statutes, and legal process. These laws establish time limits on claims, caps on monetary damages or certain types of claims, and even define elements differently (such as negligence and liability) from state to state. Some of the most important personal injury laws and statutes in Texas include:

  • The statute of limitations. Whatever you do, don’t miss the statute of limitations for filing your personal injury claim. Texas legislation imposes a two-year time limit on PI claims. You have two years from the date of your accident or the date you discover your injury to bring your claim. Missing this deadline generally means losing your right to compensation.
  • Shared fault laws. Texas is a modified comparative negligence state. This means you can still receive compensation even if you were partially at fault for the accident. If the Texas courts find you 50% or less at fault for the accident, you could receive at least partial compensation. The courts will reduce your award by your percentage of responsibility for causing the accident or injuries.
  • Caps on damages. Texas puts caps, or maximum damage amounts, on some types of personal injury compensation. Claimants can receive a maximum of $250,000 per defendant and $500,000 overall in non-economic losses in medical malpractice claims. These include pain and suffering damages. A cap of around $1.9 million (indexed for inflation) exists for wrongful death medical malpractice claims.
  • Dog bite laws. Texas differs from most states in that it does not enforce a specific statute regarding dog-related injuries and liabilities. Instead, the Texas courts will evaluate each claim on an individual basis. In general, a dog owner will be liable for the actions of a dog if he or she knew or should have known the attack might have happened. In other words, Texas, courts follow a one-bite rule.
  • Claims against the government. The Texas state government permits injured parties to file claims outside of the sovereign immunity system. However, filing claims against the government (such as the city of Fort Worth) comes with special guidelines. Most importantly, you have six months from the date of your accident to file. You must file a formal complaint with the defendant describing your accident and damages.
